No contract through an enquiry or Property File

Sending a form or creating a Property File does not create a mediation agreement, direct-purchase contract or professional advisory relationship. Applicable services begin only under the correct separate agreement.

Online Sale: scope, price and duration

Online Sale is a fixed 90-day owner-led digital property marketing and administration package for one property accepted by IMOJA. The total consumer price is €499 including VAT. Payment is due once, after the applicable agreement has been signed and the client activates the service.

The defined package includes listing preparation, basic optimisation of suitable owner-supplied photographs, agreed publication setup and maintenance, access to My IMOJA, administrative coordination of available enquiries, viewing requests and commercial offers, and a property-document readiness checklist. The owner conducts physical viewings.

Preparation begins on the agreed service start date. The 90-day active marketing period begins on the first agreed publication and does not renew automatically. Portal acceptance, availability and reporting remain subject to each portal's rules and authorised technical access.

The €499 price is not conditional on a buyer, offer, promissory contract or completed sale. No buyer, sale price or completion date is guaranteed. Failure to sell does not alone create a refund, without prejudice to statutory withdrawal rights, failure-of-performance remedies and the cancellation terms in the applicable agreement.

Real-estate mediation and Full Agency

Where IMOJA performs activity legally classified as real-estate mediation, that activity is governed by a written mediation agreement complying with applicable Portuguese law. The agreement identifies the property, intended transaction, remuneration conditions, VAT, insurance, accessory services and the effects of any exclusivity.

Full Agency is a separate team-led mediation service. Its exclusive 2% + VAT or non-exclusive 3% + VAT remuneration, applicable minimum and payment trigger are stated in its own written agreement. The €499 Online Sale price is not automatically an advance on Full Agency remuneration. Any upgrade or commercial credit must be agreed expressly in writing.

Completion Support

Completion Support brings the total fixed package price to €999 including VAT. If Online Sale has already been activated, the remaining €500 is paid when the written upgrade is activated. It adds an administrative completion timeline, reminders, document tracking, coordination with appointed independent professionals and one pre-agreed mainland IMOJA attendance. It does not constitute independent legal representation and does not guarantee completion. Additional travel, repeat appointments and independent professional fees remain separate.

Portal availability, metrics and refresh frequency depend on each authorised connection or verified report. IMOJA does not promise data that a channel does not provide and does not scrape portal interfaces.

Address search and map results

Google Maps address suggestions and map results help identify a property for the initial review. You should check the selected address and pin before continuing. A selected address, place identifier or set of coordinates is not proof of ownership, legal title, cadastral boundaries or the property's legal description; those matters require the appropriate official documents and, where needed, independent professional verification. Use of these features is also subject to the Google Maps End User Terms and Google Privacy Policy.

Direct Offer

A Direct Offer request asks SONHESQUEMA, LDA, the company behind IMOJA, to assess whether it may buy the property as principal. No mediation commission is charged if SONHESQUEMA, LDA completes that direct purchase. Any indication remains subject to due diligence, documents, funding and final approval and may be below open-market potential.

A principal purchase and real-estate mediation are separate roles. The Direct Offer process cannot run while IMOJA has a mediation instruction for the same property. If a direct-purchase assessment ends without a purchase, a market sale requires a separate written mediation agreement.

Buyer service and representation

A stated €0 direct charge to the buyer applies only where IMOJA acts on the seller side or receives agreed remuneration from a listing agency or through co-brokerage. In that arrangement, IMOJA does not act as the buyer's independent representative. IMOJA confirms its role and who pays before work begins. Legal due diligence, contract advice and legal representation require a separate appointment of the appropriate independent professional.

Electronic contracts

Where contracting is offered in My IMOJA, the final agreement is supplied as a downloadable document and signed through the designated electronic-signature provider. A generic one-time SMS code is not represented as a qualified electronic signature. The signed copy, applicable withdrawal form and available audit record are supplied in a durable form.

Consumer distance contracts

Where an eligible consumer concludes a service contract online, the applicable pre-contract information, withdrawal instructions and model form are supplied in a durable medium. The ordinary withdrawal period is 14 days from conclusion of the service contract.

IMOJA does not begin work during that period unless the consumer makes a separate express request on a durable medium. If the consumer withdraws after requesting early performance, an amount proportionate to the service actually provided may be due. If the service is fully performed, the withdrawal right is lost only where the consumer gave the required prior express consent and acknowledged that consequence. Payment at activation does not remove any mandatory consumer right. Creating a Property File is not a request to begin paid work.

Complaints and consumer dispute resolution

Consumers can first contact IMOJA through the website. They may also use Portugal's electronic Complaints Book. The competent alternative dispute-resolution entity depends on the consumer's location and the applicable territorial rules. For services supplied across mainland Portugal, the potentially competent general consumer centres are:

  • CACRC — Consumer Conflict Arbitration Centre for the Coimbra Region
  • CACCL — Lisbon Consumer Conflict Arbitration Centre
  • TRIAVE — Ave, Tâmega and Sousa Consumer Conflict Arbitration Centre
  • CICAP — Porto Consumer Information and Arbitration Centre
  • CIMAAL — Algarve Consumer Conflict Information, Mediation and Arbitration Centre
  • CIAB — Consumer Information, Mediation and Arbitration Centre
  • CNIACC — National Consumer Conflict Information and Arbitration Centre, acting subsidiarily where another territorial centre does not apply

Applicable service terms

Mediation, direct-purchase and coordination services begin only under the relevant written terms and mandatory pre-contract information. Those documents prevail for the specific service.
