The property tax record

Caderneta predial

Issued through the Portuguese Tax Authority, it normally shows the tax article, location, use, areas, registered taxpayer and taxable value. It is valid for 12 months.

The live Land Registry record

Certidão permanente

It shows the registrations currently in force and any applications still pending, including ownership, mortgages, attachments and usufruct rights. Anyone may order it online. The current online fee is €15 and the access code remains valid for six months.

Checking property documents in Portugal

Turn a folder of documents into a list of checks.

Check what each document actually says about the property. Record its source and date, compare the relevant details and decide how to resolve any outstanding questions.

1. Confirm you are comparing the same property

Match the property description, tax article, unit and location. Record which area measurement each document uses; figures with different definitions cannot be compared as if they were the same field.

2. Separate missing evidence from differences

Mark whether a record is missing, out of date or contains a difference that needs explaining. A mismatch is a question to resolve, not an automatic conclusion that the property cannot be sold.

3. Record who will resolve the question

Note the issuer or qualified professional to contact, the request date and the answer still needed. Use the unresolved items when discussing the listing, price and proposed completion timetable.

Casa Pronta

Public pre-emption.

Where it applies, file after the buyer, price and sale terms are known. Private rights need a separate check.

When this notice applies

The Casa Pronta notice is used where a public body may hold a legal right of first refusal, for example for certain listed properties or properties in protected or urban rehabilitation areas. The buyer, seller, property, price and expected completion date must already be known.

Casa Pronta covers public bodies. It does not replace a separate check for any private rights of first refusal, including those of tenants or co-owners where applicable.

How to file the notice
  1. Open the new notice form on Casa Pronta.
  2. Enter the applicant, seller, buyer and property details.
  3. Confirm the agreed price and expected completion date.
  4. Submit and pay the €15 fee through Multibanco.

Response time and follow-up

Public bodies have 10 working days to respond. Keep the request number and check the result online. If none responds within the deadline, the sale may proceed in relation to this public notice.

CPCV

Before you sign the CPCV.

Use the clause checklist to understand the agreement. Have the contract for your property reviewed before signing.

The clauses to check
  • The parties, title and exact registered property
  • Charges, occupation and what is included in the sale
  • Price, deposit, later payments and evidence of payment
  • Completion deadline and who arranges the final signing
  • Finance, document or mortgage-discharge conditions
  • Public and private pre-emption steps where applicable
  • Notices between the parties and consequences of default
  • Vacant possession, keys and handover arrangements
Form and professional review

A contrato-promessa de compra e venda is not mandatory in every transaction. When the parties sign one, however, it binds them to what is written. A useful example explains the clauses; the final text must fit the property and the deal.

The CPCV must comply with the form required by law. Depending on the property and the applicable regime, the requirements may concern the written document, signatures, certification and planning evidence. The appointed lawyer, solicitor or notary should confirm the exact form, any exceptions and the final wording before signature.

Why a generic template is not enough

A ready-to-sign universal CPCV is not provided. A generic form can omit finance approval, conflict with the property records or allocate risk in a way the parties never intended. Have the transaction-specific document reviewed before signature.

Power of attorney

Define the representative’s powers.

A power of attorney must match the transaction. Authority to sign does not automatically include authority to receive money.

Which actions may the representative take?

A power of attorney can allow another person to represent an owner during the sale, but the wording and form need to match the transaction.

  • Negotiate terms or sign the CPCV
  • Sign the final sale instrument
  • Receive the deposit or price and issue a receipt
  • Deal with a mortgage, file notices or hand over keys
  • Delegate the authority to somebody else
Registration and documents made abroad

For a change in property ownership, the official service states that irrevocable powers of attorney, substitutions, amendments and terminations must be registered. Registration of other powers of attorney is optional.

Authority to sign does not automatically mean authority to receive money. Confirm the property, powers, limits, duration, revocation and delegation with the appointed notary, lawyer or solicitor. If the document is made abroad, ask that professional whether an apostille and a certified translation are required for its use in Portugal.

Why there is no deed template here

It must reflect the actual parties, property, registrations, taxes, payments and agreed terms and be prepared and authenticated through the appropriate qualified professional.

Questions to settle before the paperwork becomes urgent.

What is the difference between a caderneta predial and a certidão permanente?

The caderneta contains the tax record. The certidão permanente shows the live legal and Land Registry position. Preparing a sale normally means obtaining both and comparing their property, area and ownership details.

Is a CPCV compulsory when selling a property?

Not in every transaction. If the parties sign one, it binds them to the agreed terms, so the wording should reflect the specific property, timetable, payments, conditions and risks.

Can I download a ready-to-sign CPCV template?

Not from IMOJA. The clause checklist and seller guide help you understand the issues, but the final CPCV should be tailored to the property and transaction and reviewed before signature.

Where is a public pre-emption notice filed?

It is filed online through Casa Pronta after the essential sale terms are agreed. The public bodies concerned then have 10 working days to respond.

Can one generic power of attorney cover any property sale?

That is not a safe assumption. The property, authorised acts, sensitive powers, limits and applicable form should be clear and checked for the particular transaction.

Does IMOJA provide a deed template?

No. The final transfer instrument must reflect the real transaction and be prepared and authenticated through the appropriate qualified professional. IMOJA helps organise the administrative sale file, not replace that work.
