Most document problems are manageable when they are found early. They become expensive when a buyer is waiting to sign. The sensible approach is to build the property file first, then compare the registry, tax and technical records instead of assuming they all say the same thing.

A practical check: an area difference is a question, not a verdict

Illustrative example: one record shows 78 m² and another shows 90 m². Before treating this as an error, write down the name of each area field and check whether it describes the same unit and type of space. A useful comparison keeps the definition beside the number rather than choosing whichever figure makes the advert look better.

Keep a short issue log with the document, field, question, person to contact and evidence still needed. The aim is to explain the difference or obtain a correction through the appropriate process before relying on the figure in the sale.

  • Record the source and issue date of each document.
  • Confirm the property description, unit and location before comparing values.
  • Separate missing documents from differences between available records.
  • Ask the issuer or appointed professional to explain unresolved points.
  • Use confirmed information in the listing and flag outstanding checks when planning the sale.

Start with the core seller file

The exact list depends on the property and the parties. For a typical residential sale, begin with civil identification and Portuguese tax identification for the relevant sellers, together with the main property records.

  • Certidão do Registo Predial or certidão permanente predial
  • Caderneta Predial issued by Autoridade Tributária
  • Licença de utilização, applicable exemption or other valid status
  • Ficha Técnica da Habitação where it exists or applies
  • Valid energy performance certificate
  • Condominium declaration for an apartment or unit in common ownership
  • Mortgage balance or repayment statement where a charge must be discharged

Registry and tax records serve different purposes

The land-registry certificate identifies the registered description, ownership and recorded charges or encumbrances. The Caderneta Predial is the tax record and contains the property details held by Autoridade Tributária.

Names, areas, address details and property descriptions should be compared rather than assumed to match. Differences do not always prevent a sale, but they should be reviewed early by the appropriate professional.

Use, technical and energy documents

The use licence or legally applicable exemption helps establish the property’s authorised use. The Ficha Técnica da Habitação applies in defined cases; the current gov.pt guide identifies it where the use licence was issued after 30 March 2004.

ADENE states that the energy class must appear in property advertising and that the certificate should be made available before the promissory contract and before the final contract. Arrange certification before marketing if no valid certificate exists.

The condominium declaration is more than a no-debt note

For a condominium property, the owner requests a declaration from the administrator. It records current charges, payment dates and any existing debts. Under the applicable rules, the administrator has up to 10 days to issue it.

A buyer can expressly waive the document in certain circumstances, but that can transfer responsibility for relevant seller debts. Treat that as a legal decision for the buyer’s independent adviser, not the normal way to fix a missing file.

Add the documents specific to the transaction

Altered buildings, inherited properties, company-owned assets and properties in protected or urban-rehabilitation areas can require additional evidence. A notary, lawyer or solicitor may request more after reviewing the title and proposed transaction.

  • Public right-of-preference notice where legally applicable
  • Evidence for alterations, extensions, pools or a change of use
  • Inheritance, divorce, company resolution or representation documents
  • Powers of attorney and identification of authorised representatives
  • Promissory contract and agreed mortgage discharge documents
  • Toponymic or infrastructure certificates where relevant
