A Portuguese home can be sold after divorce, but the listing should not be the first step. Confirm the registered owners, the status of the division, who may occupy the property and who remains liable for the mortgage. Divorce alone does not remove a borrower from a loan or update the land registry.

Separate the sale, division and mortgage

These are related but distinct decisions. A private agreement about mortgage payments does not by itself amend the bank contract, and an agreement to sell does not decide how net proceeds and costs will be divided.

Before viewings, record the planned steps, outstanding decisions and who has authority to speak and sign. Ask the legal professional handling the matter to confirm the right order for your matrimonial property regime and current registrations.

Confirm title, occupation and signatures

Compare a current permanent land-registry certificate with the tax record, divorce decision, any prenuptial agreement and property-division documents. Do not assume that the proceeds will automatically be divided equally.

Confirm who occupies the home, when viewings can happen and when vacant possession can realistically be delivered. Any family-home use agreement or court decision must be respected in the sale calendar.

Obtain a written answer from the bank

If both former spouses are borrowers, a private arrangement between them does not necessarily release either from the loan. Removing a borrower or transferring the home to one former spouse depends on the bank's procedure and agreement.

For a third-party sale, request a redemption statement for the intended completion date and the mortgage discharge procedure. The loan and other secured costs may be paid before the remaining price is distributed.

Build one net-proceeds sheet

Compare offers by their conditions and the amount left after costs. Record the expected price, deposit, mortgage balance, estate-agency fee, condominium charges, document costs, agreed works and a reserve for adjustments.

Where agreement on sale, occupation, price or distribution is missing, obtain independent legal advice before marketing. An estate agent cannot replace a property division or decide a family dispute.
